5 October 2023 - An overview of SPCs in Europe - what does the future hold?

Supplementary Protection Certificates (SPCs) were introduced in Europe to address a call for enhanced patent protection for pharmaceuticals that required regulatory approval to be placed on the market. The SPC provides a form of patent term extension for authorized medicinal products based on the product that is the subject of a marketing authorization and which is protected by a patent in force. The SPC system is distinct from patent term extension systems in other jurisdictions and presents applicants in Europe with unique challenges.

In this 30-minute webinar, we’ll run through the current state of play of SPCs in Europe and how pending CJEU referrals, the UPC and Brexit may change this going forward, offering practical tips to consider during drafting and prosecution to maximise patent term extension success in Europe.

We will consider:

  • the current requirements for obtaining a SPC in Europe and where this may be heading;

  • upcoming developments following the newly implemented UPC; and

  • how Brexit has affected the SPC landscape in Europe and how this may change in future.
