Optimizing your trademark strategy in a changing world

The day will commence with addresses from prominent speakers. The first will look at the topic from the perspective of US in-house counsel and the challenges that are faced. The second will explore adding value to IP through mediation and Alternative Dispute Resolution. This will follow with a panel discussion with the speakers to dive further into these issues.

Gretchen Stroud, Gilead Sciences, Inc

Gretchen Stroud joined Gilead Sciences, Inc. in 2008 and manages Gilead’s trademark and brand protection matters. She and her team register, enforce and defend Gilead’s trademarks worldwide, and obtain regulatory approval for product brands and international non-proprietary names. She and the brand protection team provide legal support for Gilead’s anti-counterfeiting and anti-diversion efforts and manage the company’s online and domain name enforcement. Gretchen also advises on trademark aspects of transactions, including due diligence, assignments and licenses, and copyright matters. Gretchen has been named to the World Trademark Review 300: The World’s Leading Corporate Trademark Professionals, the WTR’s Global Trademark Leaders list and the World Intellectual Property Review’s 2020 list of 100 Influential Women in Intellectual Property. Prior to joining Gilead, Gretchen practiced at a Silicon Valley law firm. Gretchen received her A.B. in English from the University of Southern California and her J.D. from Stanford Law School.

Gordon Humphreys, EUIPO

Gordon Humphreys holds an LL.B from the University of Buckingham (UK), an LL.M from the University of Wales, Cardiff, and a master`s degree in economic law from the University of Liège (Belgium) as well as a post-graduate diploma from the University of Alicante (Spain). He qualified as a barrister of England and Wales and was admitted to the Brussels Bar as an avocat in 1994. Following a period in private practice in Luxembourg, he joined the Legal Department of the EUIPO in 1997, acting in several of the earliest trade mark cases before the (then) Court of First Instance. He was Head of the Register Service from 2002-2005 before taking up his duties as a member of the Boards of Appeal in December 2005, handling both trade mark and design cases. Since September 2014, he has been Chairman of the Fifth Board of Appeal. He has published a number of articles on trade marks and designs in leading IP journals and is a contributing author in Hassleblatt, ‘Community Design Regulation (Commentary)’, C.H. Beck Hart Nomos, 2018 as well as being a regular speaker at conferences. He is also qualified as a mediator with the Chartered Institute of Arbitrators and is a mediator with the EUIPO Boards of Appeal Alternative Dispute Resolution Service. He coauthored ‘Mediation: Creating Value in International Intellectual Property Disputes’, Wolters Kluwer (2018).

Kathleen Cooney-Porter, USPTO

Kathleen Cooney-Porter is the Senior Trademark Advisor to the Under Secretary and Director of the USPTO. Ms. Cooney-Porter advises the Director and other senior leaders on a wide variety of trademark policy issues. Ms. Cooney-Porter has practiced trademark law for almost 30 years. Prior to joining the USPTO, she was a Principal at Muncy, Geissler, Olds & Lowe, P.C., since 2016, advising clients on how to enhance, secure, leverage, and enforce their marks and brand portfolio, and as a Partner at Oblon, McClelland, Maier & Neustadt, P.C., where she managed the trademark and copyright practice groups and represented clients before the Trademark Trial and Appeal Board.

Carrollanne Lindley, Partner, Kilburn & Strode

Carrollanne was named one of the World’s leading 250 Women in IP by Managing Intellectual Property. Having been called as a barrister, Carrollanne spent a year in pupillage with a Queen's Counsel specialising in intellectual property. She moved then into industry, first in-house at Rothmans International working on both luxury goods and tobacco products, and later on to 'The Body Shop'. Finally she moved into private practice, and describes this transition as 'poacher turned gamekeeper'. She joined Kilburn & Strode in 2000 and heads the firm's prominent Trade Marks Group. Carrollanne is experienced in all aspects of trade mark prosecution and enforcement both in the UK and abroad. Her experience in-house makes her particularly aware of the commercial and practical needs of her clients. She has given lectures and presentations at various professional seminars and at the Institute of Directors, and appeared on television and radio discussing IP issues.

Iain Stewart, Partner, Kilburn & Strode

Iain handles all aspects of trade mark work, with extensive experience in worldwide portfolio management, trade mark strategy and counselling, anti-counterfeiting and dispute resolution. He has a particular interest in contentious matters, reflected in his appointment as Principal Editor of the INTA International Trade Mark Opposition Guide. Beyond trade marks, Iain has an interest in the protection of industrial designs in the UK and European Community. He maintains an excellent success record in domain name disputes before Nominet and WIPO, and has handled a number of high-profile cases. His clients range from SMEs through to blue-chip multinational corporations, which are involved in all manner of business activities. Iain works as part of our integrated European team and splits his time between our London and Hilversum offices.

Harry Harden, Associate, Kilburn & Strode

Harry has a background in physics relating to medicine and has a Master’s degree in physics from the University of Nottingham. He primarily works in the software, AI, medical and music sectors, and his practice involves working on a wide range of technologies and advising clients on patent prosecution strategies across the globe. Recent work has involved significant preparation and prosecution of multidisciplinary, cross sector technologies. Such technologies include fertility testing devices, and technologies relating to the use of AI in predicting patient responses to certain drugs. Harry also has experience providing patentability opinions for machine learning technologies applied to a variety of life sciences technologies. Harry has particular experience in freedom to operate analysis and due diligence work on various scales, from start-ups to large multi-national corporations. Recent work has involved detailed patent due diligence investigations to advise on commercial implications of patent portfolios. He has previously been a member of the CIPA Patents Committee, which plays a key role in changes to UK patent law. He was also a member of PPWG, which is the UK’s chief liaison with the UK Intellectual Property Office.
