Guidance for Trans Inclusion following the Supreme Court Decision in For Women Scotland Ltd v The Scottish Ministers
IP Out is pleased to invite you to a timely and important webinar presented by the highly respected barrister Robin White (Old Square Chambers), examining the recent UK Supreme Court (UKSC) ruling in For Women Scotland Ltd v The Scottish Ministers and its implications for organisations
Robin White brings a wealth of experience in employment law, with particular expertise in discrimination and HR advisory matters. In this session, she will unpack the UKSC’s decision, which ruled that the term "woman" in the context of the UK Equality Act 2010 excluded trans women with a Gender Recognition Certificate. Although narrow in legal scope, the ruling is already having significant - and unintended - effects on the rights and day-to-day experiences of trans and non-binary individuals, as well as non-gender conforming cis (non-trans) people.
What will the webinar cover?
This session is designed to help organisations understand the implications of the judgment and explore how best to respond. In addition to explaining the decision, Robin will outline strategies for:
-
Ensuring compliance with the Equality Act 2010
-
Maintaining inclusive and respectful practices for all employees
-
Addressing misinformation and reducing discrimination in the workplace
Call to action: EHRC consultation open until 30 June 2025
The Equality and Human Rights Commission (EHRC) is currently consulting on recent updates to its Code of Practice for services, public functions, and associations, in light of the judgment. We strongly encourage organisations to respond to this consultation - and this webinar will help you do so from an informed perspective.
Who should attend?
We warmly invite the entire IP Inclusive community to join us. In particular, we encourage attendees to share this invitation with senior leadership, HR / People & Culture teams and facilities teams. Improving trans and non-binary inclusion requires informed engagement across all parts of an organisation.
We look forward to welcoming you to this important discussion.
