Today, the EPO Enlarged Board of Appeal handed down decision G1/23, dealing with the treatment of complex commercially available products as prior art. G1/23 asked the EPO to answer several key questions:

  • Do commercially available products constitute valid prior art if their composition/internal structure cannot be analysed and reproduced? 

  • Is technical information about the commercially available product (e.g. in the form of technical brochures) prior art if the product itself is not valid prior art? 

  • How should analysable and reproducible be interpreted in this context?
