Or so concluded Oscar Wilde. For a business successfully capitalising on its brand and reputation, counterfeit goods can be a less amusing reality of operating in a global marketplace. Our attorneys have experience in anti-counterfeiting prosecution and enforcement across jurisdictions. Acting in concert with a major international beauty brand, we work on the cutting edge of European law relating to countering illegal content online. Our team creatively tailors their approach to enforce the brand owner’s rights, limiting infringing activity even when this bears a striking resemblance to a game of ‘whack-a-mole’. The results are the identification of key entities with appropriate successful settlements, contentious proceedings where necessary, along with advice on how to protect the brand for the future.

Working to achieve commercial objectives

We took over a portfolio of 1200 trade marks, with over 100 oppositions worldwide from two parties. The parties’ positions had become entrenched over three years and no resolution had been found. The parties had lost sight of their objectives. By identifying the real commercial concerns of the parties (which varied by jurisdiction), opening a clear channel of communication (including face-to-face meetings) and persistence, we secured two worldwide settlement agreements. This resolved all outstanding oppositions.

Global scale filing programme

We worked with our client, a major supplier of baby products, on a new filing programme of their core three marks in over thirty countries. The company had determined not to pursue India as a serious marketplace and had only tried pushing a sample of sales via an agent. Several years later their plans changed. They then found their former agent had, via a pseudonym, filed over ten applications and two domain names for signs comprising their house brand. We led the attack for recovery of the .com domain name. We co-ordinated investigations and reviewed evidential documentation to substantiate our recovery programme via several oppositions, two cancellation actions and the initial stages of litigation, in India. Our client was very pleased with the result which was obtained, we believe, due to our doggedness and attention to detail.
